Driver Contract
1. Engagement
1.1. The Company engages the Driver as an independent contractor for the purpose of providing delivery services to the Company’s clients, primarily local merchants, and restaurants.
1.2. The Driver agrees to use their own vehicle for deliveries and to follow all applicable laws and regulations related to driving, safety, and delivery services.
2. Compensation
2.1. The Driver will receive compensation for each completed delivery in accordance with the Company’s compensation structure, which may be subject to change at the Company’s discretion.
2.2. The Driver will be responsible for all expenses related to their vehicle, including but not limited to fuel, maintenance, insurance, and repairs.
3. Schedule
3.1. The Driver has the flexibility to choose their own working hours and schedule, subject to the Company’s guidelines for availability.
3.2. The Driver is responsible for accepting and fulfilling delivery requests during the agreed-upon working hours.
4. Equipment and Uniform
4.1. The Driver is responsible for providing and maintaining their own vehicle, which must meet the Company’s safety and reliability standards.
4.2. The Driver may be required to wear a Company-branded uniform or display Company branding on their vehicle while performing deliveries.
5. Compliance with Laws
5.1. The Driver agrees to comply with all federal, state, and local laws and regulations related to driving and delivery services, including traffic laws and food safety regulations.
6. Independent Contractor Status
6.1. The Driver acknowledges and agrees that they are an independent contractor and not an employee of the Company. The Driver will not be entitled to employee benefits, including but not limited to health insurance, retirement benefits, or paid time off.
7. Termination
7.1. Either party may terminate this Contract at any time with or without cause by providing written notice to the other party.
7.2. Upon termination, the Driver agrees to return any Company-owned equipment or materials in their possession. Funds may be debited from the terminated drivers account to cover the cost of non returned items.
8. Confidentiality
8.1. The Driver agrees to keep all confidential information obtained during the course of their engagement with the Company confidential and not disclose it to any third party.
9. Governing Law
9.1. This Contract shall be governed by and construed in accordance with the laws of the State of Oklahoma.
10. Entire Agreement
10.1. This Contract constitutes the entire agreement between the parties and supersedes all prior agreements, whether oral or written.
